Personal Tax Returns (HMRC form SA100) are part of the "Self-Assessment" tax compliance system in the UK. It is called "Self-Assessment" as taxpayers are required to self-assess their tax liability. In simple terms this means that under UK law taxpayers are responsible for: a) Declaring to HMRC all relevant information and facts about their taxable income, and b) Calculating any tax payable to HMRC, and c) Paying any tax due to HMRC. Incorrect or incomplete declaration can lead to HMRC charging penalties. Penalties and interest charges also apply to late payment of tax. This engagement agreement is therefore important as it sets out your basic responsibilities, so that you understand them, and what T4 will do to assist you with tax return preparation and submission to HMRC. Your T4 Client Reference e.g A111 (if known otherwise leave blank) First Name * Surname * Your Email * NEXT - Your Legal Responsibility * Agree & Continue YOUR LEGAL RESPONSIBILITY This section is about your legal responsibilities regarding your personal tax returns Your key legal responsibilities with regards to Personal Tax Returns and "Self-Assessment" a) HMRC require taxpayers take direct responsibility for the accuracy of their own tax returns. b) Your responsibility cannot be delegated to another person, accountant or otherwise, (except for Power of Attorney). c) You must check to ensure that your self-assessment tax return is correct and complete, before it is submitted to HMRC. d) Filing deadlines for any returns remain your responsibility. e) It is your responsibility to ensure any tax is paid on time. f) Incorrect or late filing of returns, or late payment to HMRC, may lead to penalties, surcharges, and interest charges. g) You must keep records of income, state benefits or claims, expenses, or reliefs (usually for at least SIX years). HMRC can request them, e.g., during a "Tax Enquiry" or Investigation to check your declarations or tax liabilities. NEXT - Legal Responsibilities - Record Keeping * Agree & Continue YOUR LEGAL RESPONSIBILITIES - RECORD KEEPING This section is about examples of your legal responsibilities for record keeping Tax law requires that you keep records and documents to support your declarations. Examples include: a) P60s (employee tax year end gross pay and tax deducted) b) P11Ds (employee record of benefits in kind, e.g., company car, private health insurance) c) Bank statements d) Evidence of investment income, bank interest, dividends, etc. e) Credit card statements f) Invoices raised to customers (clients in business) g) Invoices, receipts, bills from suppliers (clients in business) h) Details of pension contributions i) Details of "gift aid" charitable donations j) Evidence of assets costs and disposal proceeds (e.g. property, shares) k) Other general records to support tax return entries. NOTE: This is a brief list of examples. If you are unsure what records HMRC require you to keep you should contact us for further guidance. NEXT - Your Records & Documentation * Agree & Continue YOUR RECORDS AND DOCUMENTATION This section is about disclosure of your tax records and documentation. To enable us to do our work on your behalf, you agree to: a) Fully disclose to us of all sources of income, and capital transactions. b) Provide all information necessary for dealing with your tax affairs. c) Authorise us to approach such third parties, as may be appropriate, and agreed in advance, for information necessary to deal with your tax returns. d) Provide us with information promptly. e) Provide information in the format we request where-ever possible. f) We only need copies in most instances. However, you must safely keep the original in case HMRC wish to see the original documents or records. NEXT - Family, Spouse or Partner Information * Agree & Continue FAMILY, SPOUSE OR PARTNER INFORMATION This section deals with the information we need from you about your family situation. Family details: In order to accurately prepare your tax returns we need: a) Name of your spouse or partner (if applicable). b) Date of Birth of your spouse or partner. c) Who is the higher earner (affects who pays back any Child Benefit clawbacks). d) You spouse's income levels that can also affect "Marriage Allowance" transfer claims. e) Ages of Children (if applicable). f) Details of any Child Benefit claimed. g) Who is claiming the Child Benefit. h) Number of children Child Benefit claimed for. (We have separate forms you can use to easily provide this sort of information.) NEXT - Other Personal Details Required * Agree & Continue OTHER PERSONAL DETAILS REQUIRED: This section is about other personal details we may require Student loans are repaid via PAYE or via your tax returns so you must inform us of: a) any Student loans you have b) type of student loan NEXT - HMRC Documentation & Correspondence * Agree & Continue HMRC DOCUMENTATION & CORRESPONDENCE This section is about HMRC correspondence and documentation Examples of HMRC correspondence and documents that are important you promptly provide us with copies: a) Letters from HMRC. b) PAYE Coding Notices c) Correspondence from Gov.UK or other Government departs that could affect your tax return. NEXT - Tax Advice * Agree & Continue TAX ADVICE This section is about tax advice Tax and other advice a) It is our policy, where specifically agreed, to confirm in writing advice upon which you may wish to rely, and b) We will not accept responsibility if you act on advice given by us on an earlier occasion without first confirming with us that the advice is still valid in the light of any change in the law or your circumstances, and c) We will accept no liability for losses arising from changes in the law or the interpretation thereof that are first published after the date on which the advice is given. NEXT - Limitations of the Personal Tax Return Service * Agree & Continue LIMITATION OF OUR ADVICE This section is about claims that are not made via Personal Tax Returns, are not therefore included as part of our standard personal tax return service or advice. Examples of taxable benefits that you are responsible for claiming (Not T4 via Tax Returns prepared) a) Child Benefit b) Marriage Allowance c) Pension Tax Credits d) Working Tax Credits e) Universal Credit f) State Pension g) Any other state benefits or support unless it is specifically part of a claim that can only be made directly through the tax return submission. NEXT - HMRC "Tax Enquiries" & Investigations * Agree & Continue HMRC "TAX ENQUIRIES" & INVESTIGATIONS This section is about HMRC "Tax Enquiries" or Investigations HMRC Formal Tax Enquiries or Investigations * HMRC "tax enquiries" or investigations can sometimes be long and detailed and therefore time consuming to deal with. Our standard personal tax returns service does not include the cost of dealing with a formal HMRC "Tax Enquiry". We do offer a "Tax Enquiry" service, but there is a separate agreement for that in the event HMRC select you or your tax returns for an enquiry, check or investigation. Fees are charged separately for HMRC "Tax Enquiries".
